This is a contract between us, GoGo Estate®, LLC ("GoGo Estate"), and you (the "Primary Member"), for the Estate Success Program described below (the "Membership"). In addition to the GoGo Estate® Terms & Conditions that governs your use of the GoGo Estate® website and all of our Products & Services (as defined in such Terms & Conditions), this contract (this "Agreement") constitutes a legally binding agreement between you and GoGo Estate® detailing the terms of the Membership. This Agreement is effective as of the date you accept its terms by purchasing your Membership (the "Effective Date"). If you sign up for the Membership, you accept these terms, conditions, limitations, and requirements. Please read this Agreement carefully.

THE MEMBERSHIP IS NOT A SUBSTITUTE FOR LEGAL ADVICE OR OTHER PROFESSIONAL ADVICE.

Membership

We reserve the right to accept or refuse membership in our discretion. You may not transfer or assign your Membership or these benefits to anyone else; provided, however, that if you are married or in a domestic partnership, (a) your spouse, or (b) your domestic partner will be considered an "Eligible Member" (for purposes of this Agreement, and together with you, the Primary Member, a "Member"). The Effective Date for each Eligible Member other than the Primary Member shall be the date on which the Primary Member purchases the Membership.

Benefits

The Membership provides the following benefits (the "Member Benefits"):

  1. Member Portal: The Primary Member and the Eligible Member shall have access to our membership portal (our "Portal") until the expiration of this Agreement.
  2. Estate Success Checklist: You will have access to our Estate Success Checklist found within our Portal. Our Estate Success Team will periodically add tasks to complete on our Estate Success Checklist.
  3. Access to Estate Success Team: Through the Portal, you will have access to our Estate Success Team throughout the term of this Agreement. The Estate Success Team is not a law firm or an attorney and does not provide legal advice. If legal advice is sought, the Member(s) shall be responsible for consulting with or hiring an attorney in their state for such legal advice.
  4. Discount for Immediate Family: Those in the Primary Member's or Eligible Member's Immediate Family (as defined below) will receive a twenty percent (20%) discount (the "Discount") on all GoGo Estate® plans if such Member provides the email address for such member of the Member's Immediate Family who is seeking the Discount. The Discount will not be provided if a member of the Member's Immediate Family does not provide his or her email address to access the Discount, and GoGo Estate will have no obligation to honor the Discount, nor will it be liable for failing to honor the Discount. The term "Immediate Family" shall include: (a) children of a Member; (b) grandchildren of a Member; (c) siblings of a Member (including step-siblings and half-siblings); (d) parent(s) of a Member (including step-parents); and (e) grandparent(s) of a Member (including step-grandparents).
  5. Discount for Member: The Member(s) shall have a twenty percent (20%) discount on all other GoGo Estate® plans.

The following benefits will not be included in the Membership ("Excluded Benefits"):

  1. The provision of legal advice or legal services from an Estate Success Team Member or any licensed attorney who may or may not be contracted with, an employee, directors, member, agent, officer, or other affiliation of GoGo Estate®.
  2. Tax-related advice.
  3. Advice as to which GoGo Estate® plan the Member should select.
  4. Advice about changes to the Member's GoGo Estate® plan.
  5. Assistance in executing (signing) the Member's GoGo Estate® plan.
  6. Assistance procuring a deed or other legal instrument for use in conjunction with the Member's GoGo Estate® plan or for any other purpose.

No Insurance

The Membership offered through GoGo Estate® is not a contract for insurance or indemnification insurance plan, and is not regulated as such. GoGo Estate® is not an insurance company and does not guarantee legal representation. The Membership provides GoGo Estate® customers with access to the Member Benefits outlined above.

Use

You acknowledge that GoGo Estate® reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice to you. You are responsible for all expenses incurred or other actions that may occur through your use of the Membership. You must immediately alert us of any fraudulent, illegal, unauthorized, or suspicious use of your Membership, or any other breach of security or unauthorized or illegal activity that you reasonably suspect.

Authority to Enter Agreement

You represent that you have the legal authority to enter into this Agreement. If you do not have such authority or if you do not agree with this Agreement, you may not sign up for or use the Membership. If after your purchase we find that you do not have authority to enter into this Agreement, you will be personally responsible for the obligations in this Agreement and the order you placed, including, without limitation, the payment obligations hereunder. We are not liable for any loss or damage resulting from our reliance on any instruction, notice, document, or communication, reasonably believed by us to be genuine and originating from you. If there is reasonable doubt about the authenticity of any such instruction, notice, document, or communication, we may, but are not obligated to, require additional authentication from you.

Payment

You will be charged in accordance with the billing terms in effect at the time of your initial purchase, unless you are notified of a fee change in accordance with "Fee Adjustments" below. To allow payment for the initial term of the Membership, valid credit card information is due at the time of purchase. If you have purchased an automatic renewing plan from GoGo Estate®, your Membership will renew automatically at the end of the initial term (the "Billing Date") and at the end of each term thereafter unless and until you give notice of your intention to terminate your Membership pursuant to the terms of this Agreement. If you do not give us notice of such intention, your credit card or other payment method will be charged for the renewal term of your Membership on your Billing Date. If your purchase date is on the 29th through the 31st day of any given month, your Billing Date for renewals in months with fewer days will fall on the last day of the month. GoGo Estate® may adjust your Billing Date of your latest renewal charge. Unless otherwise notified in advance by GoGo Estate® pursuant to this Agreement, the renewal charge will be equal to the original purchase price for the Membership.

You agree to pay GoGo Estate® the fees associated with your Membership. The Membership costs $19.9 per month. If applicable, we will send a reminder email to the email address of record for your account approximately one week before your Billing Date. You acknowledge and agree that this notice is provided as a courtesy only, and we are not obligated or required to provide such notice. You acknowledge and agree that (a) your failure to read, (b) inability to receive, or (c) the failure of GoGo Estate to send the email does not create any liability on the part of GoGo Estate® or any third-party service provider.

Fee Adjustments

GoGo Estate® may increase its fees for any Membership effective the first day of a renewal term by giving you notice of the new fees at least thirty (30) days before the beginning of the renewal term. If you do not cancel your membership pursuant to this Agreement, you shall be deemed to have accepted the new fee for that renewal term and any subsequent renewal terms (unless the fee is increased in the same manner for a subsequent renewal term). Reductions in fees become effective on the next renewal term without any pro rata adjustment for the period covered under the prior fee schedule.

Termination or Cancellation

By GoGo Estate®

If payment is not made on the Billing Date, you will have until the one (1) month anniversary to correct the credit card information on file and post a payment to your account. If after the expiration of this grace period you have not made any payment on your Membership, your non-payment may result in suspension of service and subsequent termination of your Membership.

Your right to use the Membership is subject to any limits established by GoGo Estate or by your credit card issuer. If payment cannot be charged to your credit card or your charge is returned for any reason, including through a chargeback, GoGo Estate® reserves the right, in its sole and absolute discretion, to suspend or terminate your access and account, thereby terminating this Agreement and all obligations of GoGo Estate hereunder. If a charge made to your credit card is declined, GoGo Estate® may make up to five (5) attempts to bill that card over a thirty (30) day period.

If you wish to reactivate your Membership after such termination, there will be no setup or reactivation fees; provided, however, accounts terminated for non-payment will be reactivated only on receipt of the full amount past due and a written request to reinstate the account. When an expired account is reactivated, the new term begins on the date of reactivation.

By Primary Member

You have the right to cancel your Membership at any time by contacting support@gogoestate.com, or by contacting one of our Estate Success Team members.

Deactivation of Account

If you or GoGo Estate® cancels your Membership, we will deactivate your account within thirty (30) days. The deactivation may include deletion of the GoGo Estate® documents that you purchased as part of our Products & Services. GoGo Estate® shall not be liable for the deletion of any documents purchased as part of our Products & Services.

Dispute Resolution

The parties agree to arbitrate all disputes and claims pursuant to the Terms & Conditions of GoGo Estate®.
